The firm has placed itself in the forefront of the new Collaborative Practice movement, an arrangement where attorneys and clients agree at case outset not to take the case to court until there is an agreement. Family Law
Russell & Herrera provides representation and legal counseling for prenuptial agreements, separation agreements, divorce planning, child custody and support issues, post-divorce planning and domestic partnership agreements and dissolution, and as necessary, litigation.

Estate Planning and Advance Directives
At Russell & Herrera we know that sound planning for the future often requires difficult decisions. For that reason, the firm strives to make these decisions as uncomplicated as possible, and best suited to individual client needs. An advance directive is a

document that states, in advance, specific instructions regarding health care and/or financial decisions in the event you are incapacitated. Services include consultation and preparations of Wills, Trusts, Durable Powers of Attorney, and Living Wills.

Fiduciary Law and Probate Administration
A fiduciary relationship is created when an individual serves as a Power of Attorney Agent, Conservator, Guardian, Executor, Administrator or Trustee. Once a fiduciary relationship is created, the fiduciary owes a fiduciary duty, described as the “highest duty under the law”, to the beneficiary of the fiduciary relationship. Fiduciary relationships are always subject to audit by the beneficiary or other interested parties.
